I accept legal responsibility for any breaches of the conditions and will be liable to any additional damage charges on behalf of all those named on this form, or any visitors to the caravan during my stay. 

I confirm that I accept that only the persons named on this booking form, or subsequently agreed written amendments, will be entitled to occupy the caravan. Breaching this condition will result in eviction from the caravan. 

I accept that the caravan will need to be handed back to the owner in exactly the same condition/standard as which it is hired to me. 

Failure to do so will result in loss of deposit to cover costs incurred. If the amount of damages done exceed the deposit amount these costs will be incurred by you the guest. 

I accept that I will lose the deposit if I do not pay the balance of the rental charge by the due date. Or if I cancel the holiday. The deposit is only refundable after the holiday has been taken. 

Compliance with the GDPR (Data Protection May 2018) law. By signing the Terms and Conditions and booking form, you give us Bucket and spades caravan hire  authorisation to hold your details. And to only supply those details on our Owners Registration form. The Owners Registration form is required between us the owner, and our site operator Bourne leisure trading  as Haven holiday parks for any private guests staying in our caravans. In both these cases they are kept for lawful purposes.

IMPORTANT INFORMATION TO READ 
BEFORE YOU CONFIRM YOUR BOOKING 

These Terms & Conditions are here to protect the rights of the Caravan Owner, and all the Guests. Please read them very carefully, as you are entering into a legally binding agreement. 

ARRANGE TRAVEL INSURANCE 
it is highly recommended that you arrange Travel Insurance to cover all guests. 
This will help protect you if you need to cancel your holiday as the owner will not offer a cash refund to you if they are not responsible for the cancellation and are unable to re-sell it themselves. They may however where availability allows agree to move your booking to a different date of same or lower value. 

YOU MUST NOT UNDER ANY CIRCUMSTANCES SELL YOUR HOLIDAY TO SOMEONE ELSE 
only those named on the booking form will be allowed to stay in the caravan. 
This means that if you have to cancel you cannot sell the holiday to someone else. ID will be required on arrival 

DO NOT ARRIVE BEFORE 4:00PM (16:00), unless agreed in advance. You can however arrive on the park from midday but there is no guarantee that the caravan will be ready for you to occupy. 
The arrival time is there to allow for cleaning after previous guests and to ensure everything is ready for your stay. 
Please check the caravan when you arrive. If you find anything wrong please inform us immediately. 

This will protect you if damages are found after you leave. An inventory is taken prior to your arrival and after departure, any breakages or losses must be paid for by you the guest. 
If anything is damaged during your stay please inform the owner immediately so that they can arrange immediate repair before the arrival of next guests. 

DO NOT LEAVE LATER THAN 10:00AM (10:00), unless agreed in advance 
you may lose your deposit if you leave late as access is required by cleaners to prepare the caravan for the next guests. 

KEEP THE CARAVAN CLEAN & SECURE 
you have a responsibility to leave the caravan exactly as you first find it. 
Failure to keep the caravan clean and tidy may result in the loss of your deposit. Do not remove any property from the caravan (full inventory taken prior to stay) or you will be charged and may face prosecution. 

All doors and windows must be closed when you leave the caravan and central heating is to be switched off. Failure to do this risks the security of the caravan and the deposit may be withheld. 

DO NOT FEED THE GULLS or other birds on the site (Haven site rules) 
This is a site rule as Feeding birds can be dangerous and creates extra mess on the site which may be poisonous. Please ensure all rubbish is put in the site bins and not left outside the caravan as wildlife will destroy it. The park hold each caravan guest accountable and may charge you if a clean-up by site staff is required. (This is out of the hands of the owner) 

YOU WILL BE EVICTED, WITHOUT COMPENSATION IF 

(Due to the insurance policy held on the caravan or Haven’s site rules) 

  • You have extra guests staying that have not been pre-registered. 
  • You cause any nuisance to others, such as loud music or shouting. 
  • Anyone is found to be smoking in the caravan 
  • You breach any of the rules of the caravan site rules. 
  • Pets are found to be/have been in the caravan (unless Caravan is rented as Pet Friendly) 
  • OR breach any of the other conditions listed below:

The agreement is made on the understanding that the Caravan Owner will remain responsible for providing the advertised service. They will be liable to compensate the guests in the event of any failing on their behalf that was not outside of their control, (This does not apply to the Sky service which is seen as an added bonus for you the guest to enjoy, if for any reason there is a loss of service, compensation cannot be claimed. 

  1. The Booking Agent 

If a booking agent is used, they will only be responsible for taking and confirming the booking and potentially accepting and transferring funds, subject to their agreed fees. They hold no responsibility unless due to their own failings. The agent may withdraw their services at any time, for whatever reason. The booking will not be affected by such a withdrawal. 

  1. The Guests 

The nominated group leader will be subject to additional costs in the event of misconduct by any of the group members that is not satisfactorily resolved, as detailed below. 

The nominated group leader accepts full responsibility and liability for the conduct of all guests should they breach any of the rules. It is their responsibility to ensure that all the guests are aware of the full details of these terms and conditions. 

No extra guests are allowed to stay overnight in the caravan, All guests must be named on booking form. You may have visitors but no overnight guests. 

The holiday must not be sold on to someone else. Any changes must be approved by the owner. 

Children under the age of 16 must not be left unattended in the caravan due to insurance conditions. 

  1. Booking Restrictions(Haven site rules) 

Bookings will only be accepted if the hirer is at least 25 years old (insurance purposes) 

An electoral roll search may be carried out by the owner or agent to confirm identity/address 

NO Same sex groups – e.g. Stag and Hen parties.(Haven site rules) 

Family and Friends same sex groups may be accepted on request. 

NO Pets of any kind are permitted in the caravan unless accepted by the owner, 

The maximum number of allowed guests may be lower than the maximum berth of the caravan. This is in order to improve the comfort of the guests. 

Only guests named on the booking form will be allowed in the caravan. 

Security have permission to carry out Spot checks any time during the holiday if any concerns have been raised. Unauthorised guests will be evicted and the remaining guests may also be evicted and forfeit the remainder of their stay, without compensation. 

Bookings 

The deposit must be paid via bank transfer to confirm booking. 
Cheques are not accepted 

Dates will be released after this period, unless owner has been notified and further arrangements made. 

Provisional bookings will not be accepted under any circumstances 

Full Names and Ages of all persons staying in the caravan are required at time of booking 

Full rental charge is due 6 weeks before holiday, otherwise the booking will be cancelled and the deposit not refunded 

  1. Deposit 

Your holiday booking will not be secured until the owner has received your deposit. This is in addition to the Rental Charge of the holiday home 

The actual deposit charge may vary depending on the season and holiday cost 

In the event of cancellation the deposit will not be refunded 

Unless cancelled by the caravan owner due to their inability to honour the booking. This would only ever be due to genuine extreme circumstances. 

Deposit will be returned within 3 days (normally sooner) of the caravan being checked, unless there has been a breach of any of the conditions by any of the guests. 

Such as, but not limited to including: 

Additional guests staying overnight 

Breaching booking restrictions 

Damage to, or theft of, contents, breach of security, etc 

Improper use of equipment 

Unreasonable behaviour 

Leaving after the agreed departure time 

Damage to the caravan or its contents or additional cleaning being required 

You have been evicted from the caravan for any reason 

Evidence of any of the above will be provided, In the form of photographs/written evidence or site staff statements where applicable 

Part deposits will not secure dates 

There will be a deduction of any delivery charges to return items that have been left behind 

  1. Rental Charge 

This is in addition to the the deposit and must be paid no later than 6 weeks before the holiday. Payment will be required in full if booking less that 6 weeks before start of holiday 

In the event that the holiday is not paid for in full 6 weeks before the holiday will be cancelled and the dates released for re-sale. 

  1. Accepted Payment Methods 

Bank Transfer 

Specific details will be provided upon request. 

Always include your Surname or Reference when making payments. 

Or by debit/credit card directly into owners account. 

  1. Cancellation 

The booking will be cancelled if: 

  1. the Full Deposit is not received 
  1. the Rental Charge is not received within 6 weeks of the start of the holiday 

The deposit will not be refunded under any circumstances unless the caravan owner is unable to provide the caravan for the required period and is unable to provide and alternative date. 

If cancelled by you within the six weeks prior to the start of the holiday the full cost will be lost, including the deposit. A partial refund may be offered if the holiday is resold at the discretion of the owner We advise all guest to take out their own travel Insurance to cover your holiday against sickness and redundancy etc. 

In the event of the holiday park being closed down, we would offer a change of date to all renters . 

You are hiring a caravan accommodation only. The park facilities are between the guest and haven when they purchase holiday passes . 

  1. Arrival and Departure 

You MUST NOT arrive before 3pm unless an earlier arrival is agreed in advance. 

You will be denied access to the caravan if you arrive early. 

You MUST be out of the caravan before 10am unless a later time is agreed in advance. 

Your deposit may be used to compensate the next guests if you leave late. 

Keys will be available as advised by the caravan owner. 

You be liable for the costs of replacing the Locks and all Key Sets if the keys are lost 

The caravan owner will not be responsible if you cut your holiday short, unless caused by problems with the caravan that the owner has not been able to rectify. 

  1. The Condition and Contents of the Caravan 

NO Smoking at any time, of any kind inside the caravan or on decking area. 

Use of drugs is forbidden. 

NO Property or owners belongings of any kind is to be removed from the caravan. 

Safety equipment, such as Smoke Alarms or Fire Extinguishers must not be tampered with, including removal of batteries from smoke alarms. 

Naked flame products, such as Candles and Barbecues, must NOT under any circumstances be used in the caravan due to insurance purposes 

All rooms must be left in the same clean, tidy condition as they were found in. 

You are responsible for the security of the caravan during your booking. 

All Windows and Doors must be locked securely when you are not in the caravan. 

Breach of any of these rules will result in eviction from the site, loss of deposit and further legal action if necessary. 

  1. Use of Equipment in the Caravan 

You are agreeing to the safe use of all equipment in the caravan 

The holiday is self-catering so you will need to provide all your own food 

All utilities (Gas, Water & Electricity) are included in the overall cost, on a fair-use basis 

In the event of excessive use, such as leaving heating on all the time, you may be charged an excess to cover the additional costs incurred by the owner for additional gas/electricity usage, (gas/electric are both supplied on a metered basis and we do run a fair usage policy. 

(Meter readings will be taken before and after rental) 

If you are unsure how to use any of the equipment provided then contact the owner immediately. Do not attempt to use anything that you are unsure about. 

The caravan owner will not be considered liable for any injury caused by improper use of any equipment 

Faulty equipment must be reported immediately. You must not use any equipment you do not consider to be in a perfect condition 

Any claims of injury must be reported immediately 

Claims will be thoroughly investigated and prosecution may be sought in the event of fraudulent claims 

  1. Behaviour 

You have a duty of care towards other site guests and as such must not cause nuisance either physically/verbally or by excessive music, etc. 

Whilst alcohol is permitted, it is expected that all guests conduct themselves in a proper manner at all times and remain civil towards the other guests and other site users. 

Children must be kept under control at all times. This includes whilst in the caravan or whilst using and services provided by the caravan site. 

In the event that dogs have been allowed, they must be kept on a lead at all times, whilst on the caravan site. They must not cause distress to any other persons on the site. 

Breach of any of these rules will result in eviction from the site, loss of deposit and further legal action if necessary. 

  1. Vehicles ONLY ONE PER CARAVAN (HAVEN SITE RULES) 

You leave your vehicle and contents on site at your own risk. Neither the caravan owner, nor the caravan site, will accept responsibility for damage or loss, unless by their negligence. 

The caravan site speed limit must be respected at all times 

All drivers must hold a Valid Driving Licence, Insurance, MOT and Road Tax(site rules) 

Electric/Hybrid vehicles MUST NOT be charged from the Caravan, as this is excessive use of electricity and you will be fined. The caravan has a limited electrical output 

Parking on the grass is not permitted in the event there is not enough parking space available there is parking for guests at the reception area. 

  1. Damage to/Loss of Property (The Caravan and/or its contents): 

Please report any accidents, losses or damages caused by you or your party as soon as possible to enable us to respond to the circumstances. The item will be ‘like for like’ part or all your deposit may be kept to cover, or contribute to replacement costs. 

Where the damage exceeds the deposit then necessary action will be taken to seek full compensation, which may include additional charges 

In the event that you are not happy with the response from the owner then you must seek legal advice, as this will protect the rights of both you and the caravan owner. 

If any intentional/malicious damage is caused to the caravan, its contents and or decking area etc. then legal action will be taken which will result in a criminal record. 

  1. Problems with your accommodation 

You must report any problems immediately, to the caravan owner, sending photos when possible. 

You must give the caravan owner a fair and reasonable opportunity to rectify problems or offer suitable compensation. 

In the event that you are not happy with the response from the owner then you must seek legal advice, as this will protect the rights of both you and the caravan owner. 

You must not make comments, or post photographs or videos in any public domain/social media, such as Facebook or Twitter, as any such action could be considered defamatory and leave you at risk of prosecution. Even posting on your own private pages is not recommended as anyone can copy and share without your permission. 

  1. Public Liability Insurance 

Names and Ages of all persons staying in the caravan are required to validate insurance 

Only named persons may stay in the caravan otherwise any insurance claims will be invalid 

Changes to approved guests may be made at the discretion of the caravan owner 

Non-approved guests will be denied access to the caravan or if they have been given access all guests will be asked to vacate the caravan immediately 

  1. Private Insurance 

The owner’s Public Liability Insurance only gives very limited protection. 

Your home insurance may cover you and your belongings whilst you are on holiday. It is unlikely to cover: Accidents, Medical Expenses or Losses due to delays or cancellation. 

We strongly recommend that you take out Holiday Insurance to cover these exemptions. These policies are available quite cheaply from most insurance brokers. 

  1. Eviction from the Caravan 

You will be evicted from the Caravan, by the caravan owner or caravan site management, and your deposit will not be refunded in the event of, but not limited to: 

Unreasonable behaviour by any of the guests 

Additional, unregistered guests being found in the caravan 

Smoking in or damage to the caravan or any of its contents 

Pets being taken into the Caravan 

  1. The Caravan Site 

The caravan owner is not responsible for any of the services and facilities provided by the caravan site. 

The site may vary services and facilities at short notice all of which are beyond the owner’s control. 

You should visit the website www.haven.com for full site details and their complaints procedures if you have any problems with anything they offer or fail to provide. 

This includes site wide power loss, closure of entertainment areas, etc. 

You are also bound by the rules of the caravan site. These can be obtained from their website or from Reception upon arrival. 

Breaching the Site Rules may result in eviction from the site and termination of your holiday 

The caravan owner will not be liable to compensate you in the event of any dispute with the site, unless it has been caused by the action of the caravan owner. 

Any passes purchased remain the property of the site owners, not the caravan owner. 
Conditions of use of the passes may be changed at any time. 

  1. Disputes and Harassment 

In the event of disputes then a third party may be consulted in order to resolve matters 

Repeated/abusive telephone calls, text messages, written correspondence or other contact will not be tolerated 

By agreeing to these terms you will not threaten legal action in the event that the deposit is not returned due to any breach of these rules. Any such action will be considered harassment 

You will be liable for any additional costs incurred as a result of any breach of these rules 

  1. Blacklisting 

In the event of non-payment, late departure, damage or breach of any conditions then future bookings may be rejected by us and other caravan owners. 

Both Haven and private owners run a blacklist and if a guest is deemed unsuitable for future rentals their name will be added onto the list. 

If for any reason the above is deemed acceptable then the owner will provide you with the reasons and may give you the opportunity to rectify the situation.
